It is a square. The first square is larger than the second square by a fraction of the border.

In the initial position the border all overlap a bit. People arguing over the shape are missing the point: the surface area seems to change when you rotate the peices. This would be strange no matter what the shape is. It's similar to this puzzle: http://www.math.duke.edu/~blake/leprechauns/vanishing_leprechaun1.htm
